Telehealth Consent

Last updated: November 4, 2026

Please read this consent carefully. By completing an intake questionnaire or using the Services, you confirm that you have read and agree to it.

1. Purpose and scope

NextAct ("NextAct") is a healthcare technology platform that connects you with licensed providers affiliated with Elite Care Health, an independent physician group, for telehealth care. Care is limited to the areas offered on our website, such as weight management, hormone health, sexual wellness, skin, hair and peptide therapy. NextAct is not a primary care provider, hospital or emergency service.

2. What telehealth is

Telehealth means receiving healthcare remotely, through online questionnaires, secure messaging, audio or video. Telehealth has limits:

  • Your provider will not physically examine you.
  • Technical problems can interrupt or delay care.
  • Your provider decides whether your condition can be treated safely through telehealth, and may refer you to in-person care.

Telehealth care through NextAct does not replace your primary care provider.

3. Your consent

  • You voluntarily agree to receive care through telehealth.
  • You agree to give complete and accurate information about your health history, medications and allergies, and you accept responsibility for the results of inaccurate or incomplete information.
  • You understand that your provider may request more information, lab work or a consultation before making a decision, may decline to prescribe, or may refer you to in-person care.
  • You understand that no prescription or result is guaranteed.

4. Risks and limitations

  • Without a physical exam, some conditions may be missed or not fully evaluated.
  • Delays can happen because of technical problems or incomplete information.
  • Despite security measures, electronic communications carry a risk of unauthorized access.
  • Any medication may cause side effects. Your provider will explain the risks of any treatment they prescribe.
  • Compounded medications are not FDA-approved. The FDA does not evaluate them for safety, effectiveness or quality.

5. Where services are available

Telehealth services may be available in all 50 states where clinically appropriate and permitted by applicable law. Availability of specific treatments can vary by state. You confirm that you are physically located in the United States when you use the Services. If you are unsure whether care is available where you are, contact us before you begin.

6. Emergencies

NEXTACT IS NOT FOR EMERGENCIES. IF YOU ARE EXPERIENCING A MEDICAL EMERGENCY, CALL 911 OR GO TO THE NEAREST EMERGENCY ROOM.

Do not use our website, intake or messaging for emergencies, including chest pain, difficulty breathing, signs of a stroke, severe bleeding, a severe allergic reaction, or thoughts of harming yourself.

7. Your relationship with your provider

Your provider-patient relationship is with a licensed provider affiliated with Elite Care Health, and is limited to the care you request through NextAct. It is not ongoing primary care and does not create a duty to provide care beyond your active treatment. Your provider may end the relationship when clinically appropriate, or if you violate our Terms of Service.

8. Privacy and security

Your health information is protected as described in our Privacy Policy and HIPAA Notice of Privacy Practices. We use HIPAA-compliant systems, require Business Associate Agreements from vendors that handle health information, and do not record consultations without your consent. You are responsible for using a private, secure device and connection.

9. Prescriptions and follow-up

  • If your provider approves treatment, your prescription is fulfilled by Rx Ave Health, a licensed U.S. pharmacy, and shipped to you.
  • Ongoing treatment may require follow-up check-ins before refills are approved. [[CONFIRM: follow-up frequency, e.g. every 3 months]]
  • Any lab tests or outside evaluations your provider requests are your responsibility unless stated otherwise.

10. Your right to choose

You may choose in-person care instead of telehealth at any time. You may withdraw this consent at any time by contacting us. Withdrawal does not affect care already provided.

11. Acknowledgment

By continuing, you confirm that you have read this consent, understand the benefits, risks and limits of telehealth, have had the chance to ask questions, and agree to receive care through telehealth.
