Terms of Service
Last updated: November 4, 2026
These Terms of Service ("Terms") govern your use of nextact.health and the related platform, communications and services offered by NextAct ("NextAct," "we," "us") (the "Services"). By using the Services, submitting an intake questionnaire or making a payment, you agree to these Terms. If you do not agree, do not use the Services.
1. About NextAct
NextAct is a healthcare technology platform that connects adults with licensed healthcare providers for telehealth care in areas including weight management, hormone health, sexual wellness, skin, hair and peptide therapy. NextAct is not a medical provider, a pharmacy or a drug manufacturer.
- Clinical care is provided by licensed providers affiliated with Elite Care Health, an independent physician group. Providers make all clinical and prescribing decisions using their own independent medical judgment.
- Prescriptions, if approved, are fulfilled by Rx Ave Health, a licensed U.S. pharmacy.
2. Eligibility
To use the Services you must be at least 18 years old, located in the United States in a state where the Services are available, able to enter a binding contract, and not prohibited from receiving telehealth services under applicable law. We may refuse or end access for anyone who does not meet these requirements.
3. How the Services work
- You choose a care area and complete an online intake questionnaire.
- You pay the consultation fee. Medical prescription consultations start from $30.
- A licensed provider reviews your intake. The provider may ask for more information, lab work or a consultation before making a decision.
- If the provider determines a treatment is clinically appropriate, a prescription is sent to Rx Ave Health for fulfillment and shipping.
- Ongoing treatment may require follow-up check-ins with your provider before refills are approved.
[[CONFIRM: how medication and any ongoing programs are billed (one-time, monthly subscription, or bundled with the consultation). Update section 5 to match.]]
4. No guarantee of treatment or results
- Completing an intake or paying a consultation fee does not guarantee a prescription. Prescriptions are issued only when a licensed provider determines they are clinically appropriate.
- Individual results vary. We do not guarantee any specific health outcome.
- Compounded medications are not FDA-approved. The FDA does not evaluate compounded medications for safety, effectiveness or quality. They are not a generic version of, or a substitute for, any brand-name product.
- All treatments may cause side effects. Your provider will discuss the risks of any treatment they prescribe.
5. Fees and billing
- Consultation fees are shown before you pay. You authorize us to charge your payment method for the consultation and for any treatment you agree to purchase.
- If you enroll in a recurring plan, you authorize recurring charges until you cancel. [[CONFIRM: recurring plans offered, billing interval]]
- You must keep your payment information accurate. We may change prices with advance notice; changes do not affect charges already made.
- Refunds and cancellations are covered by our Cancellation & Refund Policy.
6. Cancellation
You may cancel at any time by emailing support@nextact.health. How refunds work depends on the stage of your care; see our Cancellation & Refund Policy.
7. Your responsibilities
- Give complete, accurate and truthful health information, including all medications, allergies and conditions. You are responsible for the results of withholding or misrepresenting information.
- Use the Services only for yourself, and keep your account details private.
- Follow your provider's instructions and the directions that come with any medication.
- Do not use the Services for medical emergencies.
8. Medical disclaimer and emergencies
NEXTACT IS NOT FOR EMERGENCIES. IF YOU ARE EXPERIENCING A MEDICAL EMERGENCY, CALL 911 OR GO TO THE NEAREST EMERGENCY ROOM.
This includes chest pain, difficulty breathing, signs of a stroke, severe bleeding, a severe allergic reaction, or thoughts of harming yourself. 9. Telehealth consent and privacy
By using the Services you agree to our Telehealth Consent. Our handling of your information is described in our Privacy Policy and HIPAA Notice of Privacy Practices.

11. Limitation of liability
To the fullest extent permitted by law, NextAct and its officers, employees, affiliated providers, pharmacy partners and technology vendors are not liable for indirect, incidental, special or consequential damages, lost data or lost profits, or for outcomes of independent clinical or pharmacy decisions or technical failures. Our total liability for any claim is limited to the amount you paid us in the three months before the claim arose. Nothing in these Terms limits liability that cannot be limited by law.
12. Indemnification
You agree to indemnify and hold harmless NextAct and its affiliated parties from claims, losses and expenses (including reasonable attorneys' fees) arising from your use of the Services, your breach of these Terms, inaccurate information you provide, or your violation of any law.
13. Governing law and dispute resolution
- These Terms are governed by the laws of the State of [[STATE]].
- Any dispute will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, held in [[CITY]], [[STATE]], or by video where permitted.
- You and NextAct waive the right to bring or join a class action or class-wide arbitration.
- Either party may seek emergency injunctive relief in court to prevent irreparable harm.
14. Changes to these Terms
We may update these Terms. We will post the new version here with a new "Last updated" date and email you about material changes. Continued use of the Services means you accept the updated Terms.
